Abstract [sv]

Denna studie syftar till att undersöka i vilken utsträckning fastighetsmäklares standardiserade informationsdokument avseende köparens undersökningsplikt uppfyller de krav som följer av fastighetsmäklarens rådgivningsplikt enligt gällande rätt. Studien syftar även till att undersöka i vilken mån dessa dokument kan bidra till en reell förståelse hos köparen. Ämnet är relevant då rådgivningsplikten utgör en central del av konsumentskyddet vid bostadsförmedlingar, samtidigt som standardiserade informationsdokument används i stor omfattning inom branschen. Det finns däremot begränsad forskning kring hur väl dessa dokument överensstämmer med gällande rätt. Studien bygger på en kombinerad rättsdogmatisk och kvalitativ metod. Den rättsdogmatiska delen behandlar rådgivningspliktens rättsliga innebörd genom analys av lag, förarbeten, praxis, beslut från Fastighetsmäklarinspektionen och juridisk doktrin. Den kvalitativa delen består av en tematisk dokumentanalys av standardiserade informationsdokument från fyra olika mäklarkedjor avseende fastighet och bostadsrätt. Resultatet visar att dokumenten i flera avseenden uppfyller de formella krav som följer av lag och praxis. Samtidigt varierar graden av juridisk precision, fördjupning och pedagogisk tydlighet mellan företagen. Särskilt informationsgivningen avseende bostadsrätt präglas i flera fall av förenklingar trots att rättsläget är komplext och situationsberoende. Studien visar vidare att standardiserade informationsdokument utan kompletterande individuell rådgivning svårligen kan anses tillräckliga för att fullt ut uppfylla rådgivningspliktens syfte. Sammanfattningsvis visar resultaten på ett spänningsförhållande mellan standardiseringens effektivitet och rådgivningspliktens krav på individuell och situationsanpassad rådgivning.

Abstract [en]

This study aims to examine to what extent standardized informational documents used by real estate agents regarding the buyer’s duty to inspect comply with the requirements arising from the real estate agent’s duty to provide advice under Swedish law. The study also aims to examine to what extent these documents contribute to a genuine understanding on the part of the buyer. The topic is relevant as the advisory duty constitutes a central part of consumer protection in real estate transactions, while standardized informational documents are widely used within the industry. However, there is limited research concerning how well these documents correspond with applicable law and whether they actually create understanding for the buyer. The study is based on a combined legal dogmatic and qualitative methodological approach. The legal dogmatic part examines the legal meaning of the advisory duty through analysis of legislation, preparatory works, case law, decisions from the Swedish Estate Agents Inspectorate, and legal doctrine. The qualitative part consists of a thematic document analysis of standardized informational documents from four different real estate agencies concerning real property and tenant-owner apartments. The findings show that the documents in several respects fulfill the formal requirements established by legislation and practice. At the same time, the level of legal precision, depth, and pedagogical clarity varies between the companies. Information regarding tenant-owner apartments is in several cases characterized by oversimplifications, despite the fact that the legal framework is complex and dependent on the circumstances of the individual case. The study further demonstrates that standardized informational documents, without supplementary individualized advice, can hardly be considered sufficient to fully satisfy the purpose of the advisory duty. Overall, the results indicate a tension between the efficiency of standardization and the advisory duty’s requirement for individualized and situation-based guidance.
