Risk constructions when purchasing a property : A quantitative study about layman's knowledge about risk constructions in real estate acquisition. (English)
Abstract [en]
Today, there are a variety of building constructions that are referred to as risk constructions. These are specific building techniques that are very likely to cause problems such as moisture, odor, rot and mold. Some examples of these risk constructions are single-stage sealed facade, outdoor ventilated crawl space and outdoor ventilated coldwind.
For many people, a property purchase is the biggest and most important transaction in life, but it also involves a great deal of risk. A property purchase can mean major financial and legal problems, both for the current owner but also for the future one. As a starting point, a buyer has the right to demand that the property is of "normal standard" when purchasing a property. However, a purchaser of a risk construction cannot plead these types of defects. If the construction was constructed in accordance with prevailing building standards and norms, it cannot be a defect. It is also assumed that the normal buyer or layman has the extensive knowledge needed for an acquisition, according to legal guidance. This means that a buyer must be considered to have general knowledge of various construction techniques and risk constructions in a real estate acquisition. Despite this, there are in many cases inexperienced buyers of real estate and laymen who do not have a good enough grasp of either construction technology, legal or financial consequences.
A combination of quantitative method and legal dogmatic method has been used in this study where a survey was conducted. The survey that was sent out shows that the respondents are not aware or obtain the necessary knowledge about risk constructions when purchasing a property. The survey also shows that the majority of all property buyers did not take note of the current legal situation when purchasing the property and do not feel completely secure because of this.
