Abstract [sv]

Abstract [en]

In January 2020, the Convention on the Rights of the Child (CRC) became Swedish law. The government considers that the application of the CRC as a law should have an increased enforcement relating to cases affecting children. This law is so new, that no previous studies from the perspective of the judiciary system have been conducted in Sweden. The main aim of this study is to investigate how the CRC as a law affects police work with regards to children’s exposure to domestic violence. This current study seeks to provide new knowledge in the field of criminological research by increasing our comprehension of the new law and to improve our understanding on how police employees perceive how the CRC is working as a new law, and how it affects their work. To address the two study issues, eight semi-structured interviews were conducted with police employees who work with children, who are subjected to domestic violence. The results show that the new law offers increased focused on the child’s perspective within the police authority’s work, but the operational approach looks relatively unchanged. The results indicate that there are difficulties in how the legal text should be interpreted and applied in practice. Police employees request a need for clearer guidelines, education and means on how to interpret this new law, so that the law can be further implemented in their work. There is a vision that new guidelines will be introduced in a near future. One suggestion for future research is to study the impact of this new law when clearer guidelines, tools and education have been implemented.
