The prohibition against torture is part of customary international law and is prohibited under all circumstances. However, the use of torture as an interrogation technique has been a controversial issue for decades which become even more prominent in the context of the War on Terror torture.
This thesis examines the ethical and legal implications of torture in the context of the War on Terror. The central research question is whether torture can ever be justified in the War on Terror and the ethical and legal dilemma surrounding it will be examined through three moral theories, just war theory, human rights theory, and utilitarianism which were the most relatable debated theories in this context. This research investigates two real-life cases (Abu Ghraib Prison & and Guantanamo Bay) and one hypothetical case study of a ticking bomb scenario. An argumentative analysis thus will be made to answer the research question.
