Uppsatsen syftar till att belysa konflikten mellan religionsfriheten och barnens rättigheter angående manlig icke-medicinsk omskärelse genom att studera propositionen till lagen SFS (2001:499) om manlig omskärelse. Ett rättssociologiskt perspektiv kommer antas för att kunna studera lagen utifrån en moral- och normvetenskaplig ansats och inte ett strikt juridiskt förhållningssätt. Den etiska debatten som finns angående manlig omskärelse kommer därför analyseras utifrån sex stycken vetenskapliga artiklar för att belysa moraliska argument och se på vilka sätt de liknar på propositionens argument och vilka moraliska överväganden som framgår i propositionen. För att göra detta kommer en argumentationsanalys att användas som metod för att kunna lokalisera argument i både den etiska debatten och propositionen. Det slutliga resultatet av studien är att argumentationen som förs i propositionen är vinklad och tar endast upp de argument som inom den etiska debatten skulle räknas till för omskärelse. Normen genom propositionen är att föräldrarna har en bestämmanderätt över sina barn som inte ifrågasätts och det är framförallt föräldrarnas religionsfrihet som värdesätts och inte barnens.

The purpose of this study is to clarify the conflict between freedom of religion and children’s rights concerning male non-medical circumcision, by analysing the proposition of the law SFS (2001:499) regarding male circumcision. A perspective of sociology of law will be used to study the law from a moral and norm scientific view and not a strictly juridical approach. The ethical debate that exist regarding male circumcision will be analysed from six published scholar articles to find moral argument and see in which way they are similar to the propositions argument and which moral consideration that exist within the proposition. To be able to do this an argument analysis will be used to identify arguments in both the ethical debate and the proposition. The final result in this study is that the argumentation in the proposition is in an angle that only consider the argument which the ethical debate would call pro circumcision. The norm throughout the proposition is that parents are seen to have an authority and a right to decide over their children which is not questioned and it is the parents’ freedom of religion that is seen more valuable than the children’s.
