Mycket kan gå fel när avtal om köp av bostadsrätt i befintligt skick ingås, om varken säljare eller köpare är fullt medvetna om vad den här typen av klausul egentligen innebär för deras rättsliga ställning. Vi har därför i den här uppsatsen valt att undersöka begreppet befintligt skick och vilka konsekvenser en sådan klausul har när det gäller felansvar. Ett av rekvisiten för att få åberopa fel när en bostadsrätt har sålts i befintligt skick, är att det rört sig om ett väsentligt förhållande som säljaren underlåtit att upplysa om och som köparen har ett befogat intresse i att bli upplyst om. Det andra rekvisitet är då bostadsrätten är i väsentligt sämre skick än vad köparen har rätt att förvänta sig med hänsyn till priset och övriga omständigheter. Syftet med denna uppsats är att försöka bringa klarhet i vilka omständigheter som kan anses uppfylla dessa väsentlighetsrekvisit. I detta sammanhang är också av visst intresse att utreda den juridiska innebörden av ordet väsentligt, och undersöka om det förekommer olika betydelser beroende på sammanhang.

A lot of things can go wrong when you buy a condominium and sign a contract where the condominium is sold under the circumstances of “as is”. In most cases, neither the buyer nor the seller is aware of the actual meaning of the clause or the legal effect. The aim of this essay is to bring clarity to the phrase and the consequences of such a clause. One of the prerequisites to be able to plead that there is something wrong with the condominium, when it is sold with an “as is clause”, is that the seller hasn't been informed about a significant circumstance the buyer has a fair interest in being informed about. Another prerequisite is that the condominium is in significantly worse condition than the buyer should expect, considering the price and other circumstances. The aim of this essay is also to bring clarity to what circumstances that could meet these essential requirements. It is also in our interest to bring clarity to the general meaning of the expression essential and if there are several meanings due to the context.
